Millennials Are Now Old Enough To Sue For Age Discrimination
Here’s a fun exercise. The next time you hear someone complaining about “Millennials,” picture them talking about a 40-year-old. Because that’s now a thing. This year the oldest Millennials, who were born in 1981, are officially turning 40. And while this milestone is a big deal for how old it makes all of us feel, it’s an even bigger deal when it comes to us getting hired for jobs.
Under the Age Discrimination in Employment Act of 1967, you have to be 40 in order to sue a potential employer for passing on you due to age bias. While it would have been nice to have that protection much earlier in life, it’s something you can expect a lot of our generation to be taking advantage of as we get older. Especially millennial women who study show already are dealing with age discrimination.
So don’t be surprised to hear about a friend of a friend that’s taking a business to court because their application tipped off that they’re a part of the Pokemon generation. Experts say discrimination tends to peak during and after recessions so unfortunately, it’s probably going to be something many out of work people will be experiencing thanks to COVID. But at least our Millennial elders finally have the law on their side.
