Is the screen lighting up and making noises when you're not using it or you didn't get any notifications? If it does, that might tell you that someone has access to your phone. When shutting down, the smart phone has to complete tasks beforehand. So, if you try and shut down your phone and it takes a while (especially after sending a message or finishing a phone call) that might mean that your phone is trying to send information to another party.
If your phone feels really hot quite often, than it might be a sign that your phone could be being tapped. Especially if you haven't been using it, but this is only a potential sign.
